IN THE SENATE OF THE UNITED STATES

RESOLUTION

Relating to the freedom of belief, expression, and association in the People"s Republic of China.

Whereas the United Nations Universal Declaration of Human Rights and the International Covenant on Civil and Political Rightsaffirm the freedom of thought, conscience, religion, expression, and assembly as fundamental human rights belonging to all people;

Whereas the United Nations Universal Declaration of Human Rights is a common standard of achievement for all peoples andall nations, including the People"s Republic of China, a member of the United Nations;

Whereas the People"s Republic of China has signed the International Covenant on Civil and Political Rights but has yet ratify thetreaty and thereby make it legally binding;

Whereas the Constitution of the People"s Republic of China provides for the freedom of religious belief and the freedom not tobelieve;

Whereas according to the Department of State and international human rights organizations, the Government of the People"s Republic of China does not provide these freedoms but continues to restrict unregistered religious activities and persecutespersons on the basis of their religious practice through measures including harassment, prolonged detention, physical abuse,incarceration and police closure of places of worship and

Whereas under the International Religious Freedom Act, the Secretary of States has designated the People"s Republic of Chinaas a country of special concern: Now, therefore be

Resolved That the Senate calls on the Government of the People"s Republic of China to --

(1) release all prisoners of conscience and put an immediate end to the harassment, detention, physical abuse, andimprisonment of Chinese citizens exercising their legitimate rights to free belief, expression, and association, and

(2) demonstrate its willingness to abide by internationally accepted norms of freedom of belief expression, and association byrepealing of amending laws and decrees that restrict those freedoms and proceeding promptly to ratify and implement theinternational Covenant on civil and Political Rights.

決議案

有關中華人民共和國關於信仰，表達意願和結社自由。

茲鑑於聯合國世界人權宣言和國際民權及政治權利盟約將思想、信仰、宗教、表達意願及集會自由作為所有人的基本人權給予肯定；

茲鑑於聯合國世界人權宣言是所有人民和所有國家都應達到到的一個共同的標準，包括聯合國成員國之一的中華人民共和國；

茲鑑於中華人民共和國已經簽署了國際民權及政治權利盟約，而且已經認可這一條約，從而使這一盟約具法律的效力；

茲鑑於中華人民共和國憲法規定了宗教信仰自由和不信仰的自由；

茲鑑於根據美國國務院和國際人權組織的了解，中華人民共和國政府不提供這些自由而且限制未登記的宗教活動，並採取措施根據他們的宗教行為對本人進行迫害，採取的措施包括騷擾、長期拘留、肉體折磨、監禁、以及信仰場所被警方封閉；

茲鑑於按照國際宗教信仰自由法令，美國國務卿指出中華人民共和國作為一個特殊關注國：因此參議院在此呼籲中華人民共和國政府

（1）釋放所有由於道德信仰被囚禁而失去自由的人，立即停止對行使自由信仰表達意願和結社權利的中國公民的騷擾、拘留、肉體折磨與關押；（2）撤消限制這些自由的修定法規及法令並且立即採取行動認可並履行國際民權及政治權利盟約，以表明遵守關於信仰，表達意願及結社自由的普遍認可的準則的誠意。
